Planning Potential;


Local planning authorities are generally discouraged from granting permission to new isolated homes in the countryside but Paragraph 79 of the NPPF provides a mechanism through which permission can be sought, providing that the design ‘is truly outstanding or innovative, reflecting the highest standards in architecture, and would help to raise standards of design more generally in rural areas’ and ‘would significantly enhance its immediate setting, and be sensitive to the defining characteristics of the local area’.
Following the agreement of terms of purchase the buyer will be invited to enter into an Exclusive Option Contract which will have a nominal consideration of £10. The parties to the Option will be the land owner and the purchaser. This document will include the legal title to the land and the agreed price. It will protect the buyer during the agreed term of the contract while the buyer is investing in the professional services of architects and others.
